A Montgomery man accused of murdering two relatives in a house fire last summer will be observed at a state mental health facility at the request of his attorney.
Theddias LeSure, 22, was residing in a house on Riva Ridge Road in Montgomery when Kendall County prosecutors say that, early in the morning of June 13, he doused his cousin, Maurice Vaughn, with gasoline and set him on fire, killing him. The resulting fire also killed LeSure's brother, Matthew LeSure.
Homeowners Kevin and Nakia LeSure managed to escape the home during the fire via a second-story window, but suffered injuries.
During recent court hearings, LeSure's pro bono attorney, John Paul Carroll of Naperville, asked that LeSure be evaluated by the state. Carroll argued that the state law allows for such an evaluation to take place.
Kendall County State's Attorney Eric Weis said that, during a hearing last Thursday, it was ordered by Judge Tim McCann that LeSure undergo a seven-day observation by the Illinois Department of Human Services. Weis said the agency could request that LeSure be held for an additional seven days following the initial evaluation.
Weis said LeSure would be transported to a state facility at the convenience of the Department of Human Services.
"I'm hoping (he's transported) this week, but I don't know what (DHS's) availability of bed space is; since we have him housed, he's not an immediate concern (to DHS)," Weis said. "So it could be next week, or it could be this week."
